Water Law
Camisha’s working background and personal interest in water makes her uniquely qualified to assist with your water law needs. Seeking a fair resolution to your water law issues often means forming a working, professional relationship with the government agencies involved in making decisions. Camisha enjoys working with government agencies to help clients achieve their goals.
Legal issues related to water that this office can assist you with include:
Water Rights
Montana is currently in the process of adjudicating water rights in each of its basins. Water rights are extremely valuable property rights and failure to participate knowledgeably in the adjudication process could cost you some or all of your rights to use water. This office can help assess existing water rights, file for new permits or change of use permits, respond to objections and/or issue remarks and represent you in DNRC hearings and water court proceedings. Because of the uncertainties of water rights in the Flathead Basin due to the ongoing negotiations with the Salish Kootenai Tribe, understanding your water rights is more important than ever.
Ditch Easements and Well Agreements
Legal access to water can be uncertain. Just because you have a piece of paper stating you have a water right does not guarantee you have legal access to that water. Camisha has experience helping clients understand their legal right to access water based on historic use and negotiating with adjacent land owners for ensured future access.
Permitting
Any activity that physically alters or modifies the bed or banks of a perennially flowing stream requires compliance with the Natural Streambed and Land Preservation Act. Camisha has experience assisting clients in compliance with permitting requirements.
